The Technical Regulation for Cosmetics: A New Era for Ukrainian Beauty!
On August 3, 2024, the Technical Regulation for Cosmetics came into force in Ukraine.
The introduction of the Technical regulation for cosmetics brings the Ukrainian beauty industry closer to European Union standards.
KEY INNOVATIONS:
- Responsible Person: For any product placed on the market, a responsible person must be appointed who must ensure compliance with the requirements of the Technical Regulations.
- Notification: Before market launch, cosmetic products must be submitted through a dedicated notification portal (currently under development) .
- Ingredients: Cosmetic formulas must be developed taking into account usage restrictions and the list of prohibited substances (Appendices №2-6).
- Labeling: Products can be made available on the market, provided that the labeling contains all the necessary information specified by the regulation.
- Production: The production of cosmetic products must comply with Good Manufacturing Practice (GMP) requirements.
- Documentation. The responsible person must ensure a complete product information file (PIF) is available for each product, including a safety report (Appendix №1).
- Market Surveillance. Market supervision of the circulation of cosmetic products will be carried out by the State Service of Ukraine on Medicines and Drugs Control.
- Animal Testing is prohibited!
WHAT’S NEXT?
Transition period. The provision of cosmetics on the market that were put into circulation before August 3, 2026, cannot be prohibited or limited due to non-compliance with the requirements of the Technical Regulations.
The implementation of the Technical Regulation requires the resolution of many issues, including:
- the operation of the notification portal;
- the implementation of alternative testing methods;
- the approval of guidelines and clarifications to the Technical Regulations from Ministry of Health of Ukraine;
- the recognition of EU reports…
