Technical regulation for cosmetic products: what to expect?

The issue of entry into force of the technical regulation for cosmetic products is becoming more and more critical for the industry. The likely delay and the action plan for market players will be reviewed in this article.

In the coming weeks, the Technical regulation on cosmetic products in Ukraine should enter into force. Every day we receive requests about how to work and what to prepare for, given that a number of important issues for its implementation, for example, the training of toxicological experts or the launch of the notification portal – have not been resolved.

According to the Ministry of Health of Ukraine, the resolution “On Amendments to Resolution No. 65 of the CMU of January 20, 2021” is currently in the process of approval, namely, on postponing the entry into force of the technical regulation for 18 months.

 

From day to day, we await the signing and official publication of this resolution and will be sure to let you know about it.

 


It is important to understand that the main task set by Regulation (EC) No. 1223/2009 is a unified approach to the safety of products for the consumer, by ensuring the composition and labeling of products, as well as assessing this same product safety. In connection with the war, many Ukrainian manufacturers are now trying to enter new markets and have already encountered how European regulation works in practice.

Ukraine’s status as a candidate for the EU is highly likely to affect the speed of implementation of the TR, regardless of what delay is set now.

The main steps that, in our opinion, the manufacturer should take now:

  • Verification of the composition and development of formulas taking into account Annexes II, III, IV, V to the TR (we recommend working immediately according to the Annexes to Regulation (EC) No. 1223/2009 or checking the ingredients through the CosIng database)
  • Change of labeling in accordance with technical regulation requirements
  • Production must meet the requirements of ISO 22716 (GMP)
