A new technical regulation of aerosol sprayers has been approved in Ukraine

The technical regulation was developed on the basis of Council Directive 75/324/EEC

The Resolution of the CMU No. 154 of February 21, 2023 approved the Technical Regulations for Aerosol Sprayers.


The resolution will enter into force on November 25, 2023, after which the implementation on the market of aerosol sprayers that do not meet the requirements of the technical regulation will be prohibited or limited.

 

The technical regulation of aerosol sprayers was developed on the basis of Council Directive 75/324/EEC of May 20, 1975 on the approximation of the legislation of EU member states regarding aerosol sprayers. This Directive is one of the oldest EU regulations on product safety and has two goals, which are achieved through technical harmonization at the European level:

  • Ensuring that products covered by this directive are appropriately labeled and safe for consumers and other users with respect to pressure and, where applicable, flammability and inhalation hazards.
  • Ensuring the free movement of aerosol dispensers throughout the EU. Thus, Member States must allow the sale on their territory of aerosol dispensers that comply with the directive.

 

The new regulation establishes rules for aerosols with a volume of more than 50 ml, as well as new labeling requirements and requires the application of the “inverted epsilon” symbol (which is specified in the appendix to the TR) certifying compliance with this regulation.

 

In addition, the technical regulations establish the maximum permissible pressure of aerosol sprayers that provide non-combustible propellants, requirements for marking and testing of sprayers, as well as special provisions for sprayers with external types of containers (glass, plastic, metal).

The resolution also defines the market surveillance authority – the State Service for Emergency Situations (amendments to Resolution of the CMU of December 28, 2016 No. 1069).
